Permitting
Surface Water Discharge
The Montana Department of Environmental Quality has the responsibility to protect the public health and the environment by ensuring wastewater is properly handled and treated safely. Whenever a municipality, industry, or other entity wishes to discharge water to a surface water of the state, that entity must first obtain a permit from DEQ. Montana Pollutant Discharge Elimination System (MPDES) permits regulate wastewater discharges by limiting the quantities of pollutants to be discharged. The limits and/or requirements in the permit help ensure compliance with Montana’s Water Quality Standards, State and Federal Regulations, all of which were written to protect public health and the aquatic environment. The series of steps for a particular permit may vary somewhat depending on the size, nature, and complexity of the discharge.
Types of Permits
There are two types of Montana Pollutant Discharge Elimination System permits: Individual and General. An Individual MPDES permit is unique to each facility. The limitations and requirements in an Individual Permit are based on the facility's operations, type and amount of discharge, and the nature of the receiving stream, among other factors. Conversely, some point sources can be grouped under a category of sources that contain very similar or, in many cases, identical effluent limitations and requirements; their contents have been compiled into one permit, known as a General Permit.

A General Permit is one permit that covers facilities that have similar operations and types of discharge. General Permits are used to cover discharges that will have a minimal effect on the environment. Examples of this category of permit would be wastewater discharges associated with common activities, such as concentrated animal feeding operations and storm water discharges from construction or industrial activity. Written authorization from DEQ is required before an applicant can discharge under the General Permit.
A CAFO is an Animal Feeding Operation that meets certain additional regulatory criteria, primarily based on number of animals in the confined production area. A Concentrated Animal Feeding Operation (CAFO) may be designated as Large or Medium, depending on thresholds outlined in the General Permit, or by the determination of DEQ on the basis of potential to contribute pollution to state waters.

The General Permit for Construction Dewatering regulates discharge wastewater effluent from groundwater and/or surface water to state waters from construction sites, well pump tests and/or well development. Effluent limitations, monitoring requirements, and other conditions are set forth in the General Permit.

The General Permit for Disinfected Water regulates discharges into state waters after treatment resulting from hydrostatic testing or disinfecting with water containing chlorine or other approved oxidants used for disinfection. Effluent limitations, monitoring requirements, and other conditions are set forth in the General Permit.

The Domestic Sewage Treatment Lagoons General Permit regulates the discharge of treated wastewater from eligible public and private domestic lagoons to state surface waters. The General Permit includes effluent limitations, monitoring requirements, and other conditions. A completed Notice of Intent (NOI) package is required. The General Permit was recently split into two unique permits: (1) for Batch Dischargers and (2) for Continuous Dischargers. Some domestic lagoon facilities may require coverage under an Individual Permit using NPDES Form 2A.
General Eligibility Requirements
To be eligible for authorization under either the batch or continuous General Permit for Domestic Sewage Lagoons, a facility must be:
- A facultative or aerated sewage treatment lagoon; and
- Classified as a minor (i.e. have an average daily design flow of less than 1.0 million gallons per day); and
- Located within the State of Montana, except for within the boundaries of Indian Lands and excluded waterbodies (see below).
Ineligibility Requirements
Even if a facility meets the above eligibility requirements, they are not eligible for coverage under this General Permit if they:
- Have a pretreatment program (see 40 CFR 403.3);
- Accept discharge from categorical industrial users (CIU) or significant industrial users (SIU);
- Operate within the following excluded waterbodies:
- Outstanding Resource Waters or other waters of unique ecological or recreational significance, based upon considerations of Montana stream classifications, impacts on fishery resources, local conditions at proposed discharge sites, and designations of wilderness areas under 16 USC 1132 or of wild and scenic rivers under 16 USC 1274; or
- National Parks; or
- Waterbodies classified as A-1 or A-Closed waters.
- Are classified as a “new or increased source” that discharges to “high quality water,” as defined in the Nondegradation of Water Quality Subchapter 7.
Furthermore, any facility covered under an individual MPDES permit with site-specific water quality-based effluent limits (i.e. ammonia, nitrate+nitrite, nutrients) cannot request coverage under this GP.
Additional Eligibility Requirements for Batch Dischargers
In addition to the above general eligibility requirements, any facility that wishes to be authorized under the domestic sewage treatment lagoons General Permit for batch dischargers must:
- Discharge effluent as batch or with a periodic discharge strategy; and
- Discharge nine months each year or less.
Facilities authorized under the Domestic Sewage Treatment Lagoons – Batch Dischargers are prohibited from discharging during the applicable nutrient criteria period (typically July 1st – September 30

Notice of Intent (NOI) Application Package for Domestic Sewage Treatment Lagoons General Permit - Continuous Dischargers

The Fish Farm General Permit regulates discharge wastewater effluent to state waters from fish farms and hatcheries. Effluent limitations, monitoring requirements, and other conditions are set forth in the General Permit. All facilities must develop and implement a waste management plan to minimize waste discharges into state waters.

The General Permit for Pesticides is the wastewater discharge mechanism for anyone who applies pesticides into or over state surface water. This is not a pesticide permit; rather, it is a wastewater discharge permit under the Montana Pollution Discharge Elimination System (MPDES) program. A completed Notice of Intent is required. Note, in Montana, if an applicant requests coverage for annual pesticide applications in areas greater than annual pesticide use pattern thresholds list in Table 1 of the Pesticide General Permit, they are classified as above-threshold (or Tier II) facilities and are subject to additional requirements, including the development of a Pesticide Discharge Managemement Plan. If application coverage is for less than the acreage thresholds, they are considered Tier I permit holders and subject to universal requirements.

The General Permit for Petroleum Cleanup regulates discharge to state waters of wastewater from petroleum-related, contaminated water treatment facilities. Effluent limitations, monitoring requirements, and other conditions are set forth in the General Permit.

The Produced Water General Permit regulates discharge wastewater from oil/natural gas production wells to ephemeral (seasonal) drainage ways or holding ponds for the purpose of the prescribed beneficial use. The Sand and Gravel General Permit regulates the discharge of wash water, transport water, scrubber water, and pit dewatering or other process water to state waters. The General Permit for Portable Suction Dredges regulates wash water effluent into state waters. Effluent limitations, monitoring requirements, and other conditions are set forth in Parts I, II, III, and IV of the General Permit. Written authorization from DEQ is required before an applicant can discharge under the General Permit.
New applicants must secure area seasonal stream restrictions from the Montana Department of Fish, Wildlife & Parks biologist. Both new and renewal applicants must complete a Notice of Intent (Form NOI37) , which is filed with DEQ. The fee structure is included on the NOI37 form. All applicants must secure a no-cost Section 310 Permit from the local Conservation District.

Individual MPDES Permits regulate wastewater discharges from point sources that do not fall under the guidelines for a General Permit. The individual permitting process is more rigorous, as individual permits address the specific conditions of the facility or activity needing authorization.

Stormwater is rain and snow melt that runs off surfaces such as rooftops, paved streets, highways, and parking lots and that does not percolate into the soil. As water runs off these surfaces, it carries pollutants such as sediment, oil, fertilizers, pesticides, trash, animal waste and a variety of other pollutants that can negatively impact water quality. DEQ regulates discharges of stormwater from construction activity, industrial activity and from Municipal Separate Storm Sewer Systems (MS4s) primarily through three Montana Pollutant Discharge Elimination System (MPDES) General permits.
An authorization under the General Permit for Stormwater Discharges Associated with Construction Activity is required for construction activities that include clearing, excavating, grading, grubbing, or placement/removal of earth material with a total area of one or more acres.
An owner or operator of a stormwater discharge associated with construction activity is required to obtain authorization under the MPDES Stormwater Construction General Permit. An owner or operator is a person who owns, leases, operates, controls, or supervises a point source must obtain the permit. To apply for an authorization under the General Permit, submit a complete Notice of Intent application package (NOI with map, SWPPP with map(s), Sage Grouse Program consultation letter - if applicable, and appropriate fee) to DEQ. Application may be submitted through DEQ’s e-permitting system (FACTS) or by mail before the proposed construction start date.

Small construction sites under 5 acres of disturbance may qualify for Rainfall Erosivity Waivers depending on size, location, and duration of construction. A Rainfall Erosivity Waiver waives the requirement for coverage under the construction storm water general permit, but does not eliminate the requirement to implement appropriate erosion and sediment controls or allow for the violation of water quality standards.
To be eligible for the Waiver, projects must begin construction after March 30th, achieve final stabilization before November 30th, and have a rainfall erosivity factor of less than 5. The rainfall erosivity factor may be calculated using the method outlined in the instruction form, or through the EPA online calculator.

Transfer a permit:
Permit transfers to a different owner or operator are performed by submittal of a complete “Permit Transfer Notification” (PTN) form and fee if applicable.

Terminate Permit Coverage:
Once a project reaches final stabilization, and meets the additional termination requirements listed in the general permit, permittees can submit a “Notice of Termination” (NOT) form to terminate permit coverage.

Montanans rely heavily on groundwater as the primary source of drinking water for many rural domestic water supplies as well as public water systems. Groundwater is also important for irrigation, livestock, and indirectly for thermoelectric power. Montana’s programs for the protection and remediation of groundwater are driven by the need to keep groundwater safe from contamination and to protect and support the current and future uses of groundwater
The Montana Groundwater Pollution Control System (MGWPCS) program issues groundwater discharge permits to owners of potential sources of pollution to state groundwater. Typical permitted facilities include residential wastewater treatment systems, metal ore mills, lumber mills, wood product manufacturers, breweries, and community water treatment plants.
The Montana Water Quality Act (§75-5-605 ) requires a valid permit for the following activities:
(a) construct, modify, or operate a disposal system that discharges into any state waters;
(b) construct or use any outlet for the discharge of sewage, industrial wastes, or other wastes into any state waters; or
(c) discharge sewage, industrial wastes, or other wastes into any state waters.
MGWPCS permits are for discharge to state groundwaters. They are not applicable for discharges occurring within the boundaries of federally recognized Indian Lands. For additional information on discharges occurring within Indian Lands please refer to the USEPA Underground Injection Control Program
MGWPCS permits may also not be applicable for discharges located near state surface waters. For additional information on surface water discharge permits, please refer to the Surface Water Discharge (MPDES) program.
An individual MGWPCS permit is a stand-alone permit issued for a site-specific activity. Each individual permit may differ as they are based on the specifics of each discharge site and of each proposed discharge activity.
Each individual permit is placed into a category based on the type of wastewater to be discharged; either domestic (e.g. sinks, toilets, showers) or non-domestic (industrial or other wastewater). Maintenance of an existing permit is sometimes needed in order to keep the permit up to date with proposed facility or administration changes. A Modifications may be classified as either a minor or major depending on the proposed changes.
Major Modifications are typically required when the permittee plans to alter their collection system, treatment facility, or disposal structures (e.g. addition of a discharging structure, increase in design capacity). A modification may not be required when replacing like-for-like equipment, or improving the existing treatment methods.

Minor Modifications are typical when the permittee plans on undergoing minor administrative changes such as transfer of permit ownership. In order to transfer ownership, a complete PTN form, along with a $500 minor modification fee is required.

Operator Assistance
In Montana, all drinking water treatment plants, wastewater treatment plants, or water distribution systems must be operated under the supervision of a fully certified operator to ensure the proper management, operation, and maintenance of the system. DEQ administers both the water and wastewater operator certification programs and provides testing and program information services to ensure comprehensive, ongoing training is provided to Montana’s water and wastewater operator community.

Wastewater Exam ApplicationThe Wastewater Application Checklist outlines the requirements to become a certified wastewater operator. Drinking Wastewater Application is for r certification as an operator of a municipal, industrial, or on-site wastewater treatment system.
Montana law requires all water and wastewater facilities be maintained by a Certified Operator. Contact DEQ for information regarding what to do if you do not currently have a certified operator for your facility.
DEQ may issue a Temporary Operator Certification to an operator responsible for a specific system who does not meet the full certification requirements. A temporary certificate can be granted upon:
- (a) Written request to DEQ by the system owner and verification by the owner that the system is unable to employ a fully certified operator; and
- (b) A finding by DEQ that the operator has the basic knowledge necessary to operate the system and that public health will be protected.
The department shall base its decision on:
- the results of any on-site inspection of the system;
- review of the plans and specifications of the system;
- review of the operator's records, experience and training; and examination of any other reasonably available and relevant information.
A temporary certificate is effective for six months from the date of issuance, or until the operator becomes fully certified, whichever occurs first. A temporary certificate is valid only for the person to whom it is issued, for the system identified on the certificate, and for the period of time identified on the certificate.
Temporary Operator Certification ApplicationApplicants for reciprocity certification must show they have met certification requirements which are at least equivalent to the Montana requirements.
To apply for certification in Montana by reciprocity, an applicant must:
- Hold a valid water or wastewater certification in another state.
- Meet Montana’s minimum experience requirements for the type of certification you are requesting.
- Be in responsible charge of a system in Montana.
- Have an approved Montana certification application on file. To have your application approved, you must fully complete a Montana application for the classification and type that is comparable to the certification you currently hold in another state.
- Submit with your application:
- A letter outlining the requirements for the certification you hold in another state, how you met those requirements, and the amount of experience you have had with specific types of systems or treatment processes.
- Copies of your credentials of certification and any other supporting documents, including the name and phone number of the certification contact in the other state
- $70 reciprocity fee and $70 application fee for each water and wastewater application.
If your request for reciprocity is approved, you will receive the appropriate certification in the mail. Note that since other state agencies must be contacted to verify information, this process may take up to six weeks to complete.
Operators can now check their CEC status reports online at Operator CEC Totals. Please allow two to three weeks after attending training for CECs to show up in the CEC status report. Contact the DEQ at 444-3434 if you find any errors or discrepancies on this report.

Compliance and reporting is critical to maintaining both Montana’s public water supply and the health of Montana lakes, rivers, streams and wetlands. DEQ conducts a variety of inspections and requires mandatory reporting to ensure compliance and protection of public health and Montana waters.
The purpose of a sanitary survey is to protect public health by ensuring a water system is able to consistently and reliably deliver an adequate quality and quantity of safe drinking water to the consumer and to maintain compliance with regulations.
To achieve this, the surveyor will evaluation eight key elements of a water system.
Eight Key Elements of a Sanitary Survey:
- Source
- Treatment
- Distribution system
- Finished water storage
- Pumps, pump facilities, and controls
- Monitoring, reporting, and data verification
- System management and operation
- Operator compliance with state requirements
In addition, technical assistance can be provided during the survey visit. This can be an opportunity to clarify proper monitoring and sampling requirements or procedures and be informed of any upcoming changes in regulations.
How Often are These Surveys Conducted?

DEQ is authorized by state law to require compliance with environmental laws, federal regulations, and state rules regulating surface water discharge and storm water permits. Compliance activities include traditional enforcement methods, such as inspections and public complaint response, as well as technical assistance.
Compliance Evaluations Inspections (CE() determine a facility’s status with regulations, permit conditions, and other program requirements. Inspectors also verify the adequacy of sampling and monitoring conducted and the accuracy of information submitted to DEQ.
Compliance Inspection Process
There are four major components of a compliance evaluation inspection. In addition, the review and submission of the inspection report package is to be completed by the permittee following the inspection:
- Entrance Meeting
- Records Review
- Site Evaluation
- Reporting Preliminary Findings
- Inspection Report
Entrance Meeting
During the entrance meeting, the inspector will inform the on-site personnel of the reason for the Compliance Evaluation Inspection (CEI) and provide an overview of the process. Examples of information discussed during this portion of the CEI include:
- Identification/verification of the owner/operator;
- A determination of who is the authorized representative for the facility;
- A determination of whether the facility is being leased, the names, addresses, and telephone numbers of the lessor and lessee;
- Address questions concerning the history of the facility including any discharges which may have occurred;
- A determination of the conditions at the facility as they exist at the time of the CEI.
Records Review
During the Records Review portion of the CEI, the compliance inspector will review the facility-specific records to ensure the permit stipulated recordkeeping and reporting conditions are being met. Depending on the type of permit, the inspector may request copies of the following information:
- General Permit/Authorization Letter
- Individual Permit
- Operational/Laboratory/Facility Monitoring Records
Facility Site Evaluation
During the Facility Site Evaluation, the compliance inspector will assess site conditions and determine if the number and location of discharges are as described in the permit, and if the discharges are in accordance with the permit provisions. The inspector will verify operational conditions, including best management practices. The inspector will also review whether nutrient reduction plans are being implemented, assess the condition and adequacy of implemented plans, and determine areas of noncompliance.
Report of Preliminary Findings
At the conclusion of the inspection, the compliance inspector will provide preliminary findings and explain the Inspection Report process. If additional information is required from the permittee to complete the CEI, the inspector will provide a list of information and specify a date for submittal. Permittees are encouraged to ask questions so issues that arose during the inspection can be clarified.
Please Note Any information presented during the exit report is preliminary. The final factual findings and observations will be documented in the Inspection Report Package.
Inspection Report
Documented areas of noncompliance that require the permittee to complete corrective action will be reported in the Inspection Report and require the permittee to complete corrective actions to return to compliance. Additional information included in the Inspection Report Package may include areas of potential noncompliance. The Final Inspection Report Package will include:
- Cover Letter
- Completed MPDES 3560 Compliance Inspection Form
- Narrative Inspection Report
- Photo Report
The permittee is required to compose a written response addressing each one of the factual findings and observations presented in the Narrative Inspection Report. The Letter of Violation will specify a date the written response is due. The purpose of a storm water construction Compliance Evaluation Inspection (CEI) is to assess the adequacy of the Storm Water Pollution Prevention Plan (SWPPP) by ensuring the plan meets the requirements of the General Permit, reviewing how pollutants are being managed, and determining whether pollutants are being discharged from the construction site and to state waters.
Storm water construction CEIs are typically completed during and/or immediately following precipitation events. During a CEI, an inspector will conduct a records review, facility site evaluation, and review the SWPPP and SWPPP Site Map to ensure compliance with the General Permit.

Noncompliance reporting is required when a permittee identifies condition(s) that are not in compliance with or when a permittee determines they will not be able to comply with a condition(s) of their permit. Examples of noncompliance include: any noncompliance that may endanger health or the environment; a discharge of pollutants from the construction project site to state waters; failure of installed Best Management Practices (BMPs); and failure to conduct inspections.
Timelines to Report Noncompliance
Permittees are required to adhere to the following oral and written reporting timelines.
24-Hour Notification
The permittee must provide an oral report to the Compliance Inspector within 24 hours of first identifying the noncompliance. If the event of noncompliance occurs on a weekend, leave a message on the Water Protection Bureau’s main number: (406) 444-5546 or the Water Quality Division line at (406) 444-6697.
Written Report
A written report must be submitted to the Compliance Inspector within five days of the discovery of noncompliance. The Discharge Permit Noncompliance Reporting Form must be completed and mailed to the address below within five days of the 24-hour oral report.

An unintentional discharge of raw sewage from a sanitary sewer (sanitary sewer overflow), which does not occur at the designated waste water treatment plant outfall, can seriously endanger public health and contaminate waters, causing serious water quality problems.
Timelines to Report Noncompliance
Permittees are required to adhere to the following oral and written reporting timelines.
24-Hour Notification
Information must be provided orally to the Department of Environmental Quality (DEQ) within 24 hours from the time the overflow was discovered. The 24-hour report of noncompliance must be made to the DEQ Water Protection Bureau at (406) 444-5546 or to the state Office of Disaster and Emergency services at (406) 841-3911.
Written Report
A written report must also be provided within five days from the time the overflow was discovered. All sanitary sewer overflows, no matter the circumstances or cause, must be reported to DEQ, even if you do not believe a violation has occurred.
